By accessing or using the HomeCall Guide website (homecallguide.com), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our Site. These Terms constitute a legally binding agreement between you and HomeCall Guide.

2. Description of Service

HomeCall Guide is an independent home services referral directory. We provide a platform that connects homeowners and property managers ("Users") with licensed, local home service contractors ("Service Providers") in Kentucky.

HomeCall Guide is a referral intermediary only. We do not employ Service Providers, we do not perform home services ourselves, and we are not a party to any agreement between you and a Service Provider. All service agreements, warranties, and responsibilities exist solely between you and the Service Provider you engage.

3. Referral Service Disclaimer

HomeCall Guide does not guarantee the quality, timeliness, legality, safety, or any other aspect of the services provided by Service Providers in our network. While we make reasonable efforts to verify that referred providers hold appropriate Kentucky state licenses and insurance at the time of referral, we do not continuously monitor or guarantee the ongoing compliance or quality of any Service Provider.

You are strongly encouraged to independently verify a Service Provider's credentials, license status, and insurance coverage before authorizing any work. All hiring decisions are made at your sole discretion and risk.

4. Compensation Disclosure

HomeCall Guide may receive compensation from Service Providers in our network when a qualified inbound call is received through our platform. This is a pay-per-call referral arrangement. This compensation does not affect which providers are listed, nor does it create any warranty, guarantee, or special relationship between HomeCall Guide and any Service Provider.

5. Use of the Site

By using this Site, you agree that you will not:

• Use the Site for any unlawful purpose or in violation of any applicable regulations
• Attempt to gain unauthorized access to any portion of the Site or its systems
• Use automated means (bots, scrapers, crawlers) to access or collect data from the Site without our prior written consent
• Interfere with or disrupt the integrity or performance of the Site
• Impersonate any person or entity or falsely state your affiliation with any person or entity
• Submit false or misleading information in any form or communication through the Site

6. Intellectual Property

All content on this Site - including text, graphics, logos, icons, and software - is the property of HomeCall Guide or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this Site without our express written permission.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HOMECALL GUIDE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SITE
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE, INCLUDING SERVICE PROVIDERS
• ANY SERVICES PERFORMED OR NOT PERFORMED BY SERVICE PROVIDERS IN OUR REFERRAL NETWORK
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT

IN NO EVENT SHALL OUR AGGREGATE LIABILITY TO YOU EXCEED ONE HUNDRED DOLLARS ($100).

8. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Kentucky.

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site. Your continued use of the Site after any changes constitutes your acceptance of the new Terms.
